Contracts


All University of Calgary contracts must be reviewed by one of the following departments (who will also provide you with the individual who has signing authority):

Term: Sep. 1, 2018 to Aug. 31, 2020

This agreement is to be used when UCalgary personnel are using Fortress Mountain lands for either research or educational purposes.  Prior to requesting this access, ensure that you have:

  • read through the terms and conditions of the land use below (both general as well as for education use)
  • reviewed the Fortress Mountain Resort - Contractor Vehicle Driving Policy (Appendix D).

Each time you wish to access the land, you are required to complete Appendix C (do not sign it) and send it to your contact at Fortress for Chris Chevalier's signature. Once that has been done, send the scanned copy to riskmgmt@ucalgary.ca for the university's authorized signature. A copy of the fully signed Appendix C will be sent back to you and Fortress Mountain.

General Terms and Conditions

Both Fortress and the University of Calgary Acknowledge

  • They do not foresee any unusual safety risks arising from the activities that cannot be acceptably mitigated with prudent safety protocols that a reasonable person would exercise when working in a remote location in the Rocky Mountains of Alberta.
  • They do not foresee any damage to the lands due to the activities.
  • The lands comprise forested and alpine areas, containing potentially dangerous wildlife including, but not limited to, bears, cougars and lynx.
  • The lands are remote, with limited cellular service, and very few people present, particularly in the spring to fall seasons.
  • Prudent safety practices include carrying bear spray and bear bangers for activities undertaken in the spring to fall seasons and using a check-in protocol after participants have left the lands.
  • Fortress Mountain undertakes avalanche control activities in the winter solely for the purposes of its own operations and does not guarantee the safety or stability of the lands.
  • Each party shall, if requested by the other party, assist to with rescue efforts and provide reasonable resources in the event of an injury or emergency on the lands during the activities.
  • The lands may be utilized at any time by multiple users, including research groups, movie productions, service providers, and Fortress Mountain’s own operations crews. The parties agree to co-operate in sharing the lands with all usage and users and shall reasonably work together to find mutually suitable options in the event of a usage conflict. 

The University of Calgary Shall

  • Account for each participant at the end of each day before departing the lands.
  • Be mindful of other groups working within the lands concurrently and conduct the activities with the safety of all land users in mind.
  • Ensure that all garbage is removed from the lands at the end of each day of the activities.

Fortress Mountain Holdings Shall

  • Make the shelter and hard-wired phone line in the cat shop building available to the participants if the landowner’s staff or its custodian are present.
  • Identify any cat skiing terrain and avalanche closure areas to the university with all necessary documentation and maps, prior to the activities and as early as practicable.

Educational Activities

  • The only allowed educational activities are avalanche safety training and outdoor survival skills training. If you are planning other types of educational activities, you must contact riskmgmt@ucalgary.ca to determine if they can be added to the master agreement.
  • Costs for such activities are in the master agreement, contact riskmgmt@ucalgary.ca for this information.

For Educational Activities

The University of Calgary Shall

  • Have the option to station one or more 15 passenger van(s) at the lands, at the university’s own risk, between the first and last day of the activities.
  • Have the option to establish up to two beacon basins at locations approved by Fortress Mountain.
  • Avoid operating on terrain that Fortress Mountain has identified as cat skiing terrain.
  • Not enter areas identified as permanent or conditional avalanche closure areas without Fortress Mountain's consent.

Fortress Mountain Shall

  • Maintain the Fortress Mountain access road to a standard sufficient to permit a 15-passenger van empty of passengers with steel chains to drive uphill on weekend days and any other days identified to Fortress Mountain at least two days in advance, noting however that the Fortress Mountain may be temporarily prevented from doing so by significant weather events.
  • Provide portable toilet access for participants.
  • Provide the participants access to a sheltered area, if such an area is available.
  • If the university establishes one or more beacon basins, have usage access to one such beacon basin.
  • If permitted by the third party, link the university with any third party group or project that the university may request.

The university has a master agreement with Girl Guides of Canada for use of university facilities and instructional services. When Schedule B has been completed and signed by both parties, informed consents and waivers are not required to be signed.

Girl Guides of Canada

Girl Guides - Schedule A

All activities take place on university property unless otherwise noted.

  • Anatomy Labs - Faculty of Medicine - instructional/educational programs
  • Aquatic Centre - facility rental and/or instructional programs that include:
    • Swimming lessons
    • Water fitness
    • Water sports
    • Entry SCUBA
    • Red Cross Water Safety Instructor certifications
    • Lifesaving Society lifesaving and lifeguarding certifications
    • Boating safety and snorkeling
  • Climbing Room - facility rental and or instructional programs
  • Gymnasiums & Gymnastics Centre - facility rental and/or instructional programs that include the following activities:
    • Volleyball
    • Basketball
    • Badminton
    • Gymnastics
  • Kananaskis Field Station - instructional programs and/or meals and/or program resources and/or accommodations that include:
    • Outdoor science educational programs
    • Field trips
    • Professional development  programs
    • Ecology education programs
    • Environmental education programs

All of the Kananaskis Field Station services may be either full support (which includes instruction, meals, program resource and sometimes accommodations) or self-directed (which includes accommodation only)

  • Minds in Motion - Instructional programs that use University facilities
  • Outdoor Program Centre - instructional programs that include:
    • Avalanche awareness course - lecture presentations only
    • Backpacking - Kananaskis Country or wilderness areas where the university has a permit to teach these activities
    • Bike repair clinics
    • Canoeing - takes place at:
      • The university's pool and/or a community pool (if it takes place at the university's pool it may also include facility rental)
      • City of Calgary locations such as:
        • Glenmore Reservoir
        • Bowness Lagoon and/or City lakes and ares where the university has a permit to teach these activities
        • The Bow River
      • Kananaskis River and/or lakes and wilderness areas where the university has a permit to teach these activities
    • Climbing and Bouldering
    • Cross country skiing - takes place at:
      • City of Calgary locations where the university is contracted/permitted to teach these activities
      • Kananaskis Country or wilderness areas where the university has a permit to teach these activities
    • Glacier hiking/mountaineering skills - Equipment rental and/or instructional programs which take place at:
      • Kananaskis Country
      • Banff Park
      • Wilderness areas where the university has a permit to teach these activities
    • Guiding services - for hiking trips or interpretive walks which take place at:
      • Kananaskis Country or wilderness areas where the university has a permit to teach these activities
    • Inline skating - takes place on university property
    • Kayaking - takes place at:
      • The university's pool and/or community pool (if it takes place at the university's pool, it may also include facility rental
      • Glenmore reservoir
      • Bowness Lagoon and/or city lakes
      • The Bow River
      • Kananaskis River or wilderness areas where the university has a permit to teach these activities
    • Mountain biking - may take place:
      • On university property
      • Other trail areas within the City of Calgary; or
      • Kananaskis Country or wilderness areas where the university has a permit to teach these activities
    • Outdoor rock climbing - Kananaskis Country
    • Sea kayaking - takes place at:
      • The university's pool and/or a community pool (if it takes place at the university's pool it may also include facility rental)
      • Glenmore reservoir
      • Bowness Lagoon and/or city lakes
      • The Bow River
      • Kananaskis River or wilderness areas where the university has a permit to teach these activities
    • Snow shelters - takes place at Fortress Mountain
    • Snowshoeing - takes place at:
      • City of Calgary parks
      • Kananaskis Country
    • Stand up paddle boarding - takes place at:
      • The university's pool (it may also include facility rental) and/or
      • A community pool
      • City lakes and any other areas where the university is contracted/permitted to teach these activities
      • Outside of Calgary, areas may include:
        • The Bow River
        • Kananaskis River or wilderness areas where the university has a permit to teach these activities
    • Telemark skiing - takes place at:
      • Fortress or Nakiska (not including any areas with avalanche hazard)
    • Whitewater rafting and/or river rafting - takes place on the:
      • Bow River
      • Red Deer River
      • Kootenay River or wilderness areas where the university has a permit to teach these activities
  • Racquet Center - Facility rental and/or instructional programs
  • Rothney Astrophysical Observatory, Priddis, Alberta - Instructional/educational programs
  • Skating - takes place at:
    • Bowness Park
    • The Olympic Oval (which may include facility rental and/or instructional programs)
  • Sports Clinics - which may include:
    • Football clinics and/or training camps
    • Basketball clinics and/or training camps
    • Volleyball clinics and/or training camps
  • Spray Lakes Gymnastics Centre - Facility rental and instructional programs that include gymnastics
  • University of Calgary Community Garden - gardening activities that may include planting, weeding, digging, and watering
  • University of Calgary Facility Tours - touring activities that may include spaces throughout the university campuses including, but not limited to, laboratories
  • Young Persons Accessing Laboratories - this program uses the university's laboratories and facilities that have been deemed appropriate for youth and would include activities such as the Science Fair Mentorship Programs
  • Cybermentor Program - this program uses the university's laboratories and facilities that have been deemed appropriate for youth. Activities may include workshops with animals and chemicals deemed age-appropriate

The Department of Real Estate, Leasing and Land Holdings are the designated department responsible for negotiating and contracting all long term spaces leases on behalf of the University of Calgary.

In order to insure a new long-term leased space to the university's property insurance policy, the Adding New Leased Spaces form must be completed and submitted to riskmgmt@ucalgary.ca.

The university has master agreements with some school boards for use of university facilities, instructional services, job shadowing, mentoring, etc.

For current master agreements, there is both a list of approved activities and an appendix/schedule that must be completed for the school board to use your facilities/services. Once that is signed their students are not required to sign our waivers or informed consents.

If the school board that wishes to use your services/facilities is not listed below, they will be required to have their students sign our informed consents/waivers and possibly sign a facility rental agreement. If they wish to negotiate a master agreement, have them contact university Legal Services at 403.220.2518.
