Professors cited in Supreme Court decision on Redwater case
Professors Nigel Bankes and Fenner Stewart had their research cited in Orphan Well Association v. Grant Thornton Ltd., which was released on January 31, 2019.
Nigel's ABlawg post Majority of the Court of Appeal Confirm Chief Justice Wittmann’s Redwater Decision and Fenner's article “How to Deal with a Fickle Friend? Alberta’s Troubles with the Doctrine of Federal Paramountcy” (in 2017 Annual Review of Insolvency Law) were both cited in the decision that concludes that the trustee for a bankrupt Alberta energy company cannot simply walk away from unprofitable wells on agricultural land without having to clean up.
